How Slovenian airport smoking works
Slovenia’s Act Restricting the Use of Tobacco and Related Products (Zakon o omejevanju uporabe tobačnih in povezanih izdelkov, ZOUTPI, Uradni list RS 9/17, 29/17 and 31/24), article 39, bans smoking and the use of tobacco and related products, e-cigarettes with or without nicotine and heated tobacco included and only chewing and snuff tobacco excepted, in every enclosed public place and workplace; the public places the Act lists include transport and public transport premises and their waiting rooms, which covers an airport terminal. An enclosed place is one with a roof and more than half of its walls or sides closed, windows and doors counting as closed. The outdoor ban reaches only the grounds of buildings used for upbringing and education, so the open ground outside a terminal is for the airport to regulate. The exception that allowed a public smoking room (the former article 40 and the 2017 regulation on smoking rooms, with its separate ventilation and 5 Pa negative pressure) was repealed by the 2024 amendment and applied to existing rooms only until 31 December 2025; the exceptions that remain cover smoking rooms at accommodation providers, care homes, prisons and psychiatric care, not airports. A person who smokes or uses an e-cigarette or heated tobacco where article 39 bans it is fined €125 to €5,000; a legal person that fails to enforce the ban €4,000 to €33,000, its responsible person €800 to €2,000 and a sole trader €1,600 to €8,000 (articles 42 and 43). Ljubljana Airport’s regulations of October 2026 still list a smoking room on the first floor and allow smoking in its marked smoking areas airside, so ask staff whether the room is open.
